There are no administrative prerequisites to filing a lawsuit for unpaid wages under the FLSA, IMWL, or IWPCA. The same holds true for individuals stating a claim for a violation of the FMLA or Section 1981. However, if an individual wishes to file a federal lawsuit on the basis of claims under Title VII, the ADAAA, or the ADEA, he or she must first exhaust his or her administrative remedies by filing a charge with the Illinois Department of Human Rights or the Equal Employment Opportunity Commission.
